“KVKK” Law on Protection of Personal Data

This information note has been prepared to provide information about our policy on processing and transferring “personal data” in accordance with the Law on Protection of Personal Data (“KVKK”) numbered 6698. Your personal identity information, address, phone number, email address, health records, tax number and other information will be considered as your “personal data” in accordance with the Law on Protection of Personal Data (“KVKK”) numbered 6698.

We, as Çimentaş Education and Health Foundation School Commercial Enterprise (“Işıkkent School”), give utmost importance to processing your personal data in a sensitive and careful manner in line with our educational services and in accordance with the Law on Protection of Personal Data (“KVKK”) numbered 6698. We take relevant technical and administrative measures in line with the present technological opportunities to provide the necessary security level required to process and protect your personal data securely within law.  In this context, we would like to inform you about how your personal data is processed and with whom it may be shared under specific conditions.

Data Controller

Your personal data will be processed by Çimentaş Education and Health Foundation School Commercial Enterprise (“Işıkkent School”) as the “Data Controller” within the scope of the explanations specified below and in accordance with the Law on Protection of Personal Data (“KVKK”) numbered 6698. 

As “Işıkkent School”, we will record and process the following data:

• Identity information including your name, surname, birth date etc.,
• Contact information including your phone number, email address, home address, work address etc.,

. Bank account information for banking transactions related to your salary etc.,

• CV information,
• Behaviour and digital trace data acquired through cookies when you access our websites,

. Your logs, behaviour and digital trace data acquired through school’s internet connection,

• Your phone calls with the Admissions Office and Finance Department, which are recorded for quality assurance purposes,
• Security camera footage recorded within the campus.

Your personal data will be processed for the following purposes:

• For employment documents and contracts required by the Ministry of Education,
• For notifications to be sent via email, K12NET, SMS etc.,
• For invoices to be issued by the Finance Department,
• For technical and administrative measures to be taken regarding the security of our systems and applications,
• For the communication of essential data and documents with business partners with the aim of presentation and development of our products and services.

Your personal data will be shared with the following people/institutions in line with the relevant law and regulations, and based on the purposes indicated above:

• Service providers which offer us infrastructure and software services, and business partners with whom we work cooperatively regarding our software products,
• Official institutions and organizations including regulatory and supervisory authorities,
• Third parties which offer us consultancy services (lawyers, tax advisors etc.),
• ÖZ-KOÇ company (ÖZ-KOÇ TURİZM TAŞIMACILIK AKARYAKIT GIDA TARIM ÜRÜN. SAN. VE TİC. LTD.ŞTİ.), which needs your home/work address and phone number for transportation services,

. AEA company (AEA ÖZEL SAĞLIK HİZMETLERİ YAŞLI BAKIMEVİ MED.SAN.VE TİC.LTD.ŞTİ.) for infirmary and health services.

Your personal data will also be shared with other business partners based on a confidentiality agreement involving provisions about data transfer and the principle of proportionality, and in conformity with law and good faith.

Your personal data are processed for the above-mentioned purposes, and in full compliance with the relevant articles and principles set forth by the KVKK in order for Işıkkent School to maintain its educational activities and fulfil its rights and responsibilities properly in accordance with the relevant legislation.

Pursuant to the KVKK, you have the right to learn whether your personal data are processed or not; to request information if your personal data are processed; to learn the purpose of your data processing and whether this data is used for intended purposes; to know the third parties to whom your personal data is transferred at home or abroad; to request the rectification of the incomplete or inaccurate data, if any; to request the erasure or destruction of your personal data when the intended purposes expire; to request notification of the operations carried out regarding the rectification of the incomplete or inaccurate data and/or the erasure or destruction of your personal data to third parties to whom your personal data has been transferred; to object to the processing, exclusively by automatic means, of your personal data, which leads to an unfavourable consequence for you; to request compensation for the damage arising from the unlawful processing of your personal data.

Pursuant to the 1^st paragraph of the 13^th article of the KVKK, you shall lodge an application in writing to the

controller about your demands concerning the implementation of this Law or via other methods specified by the Personal Data Protection Board. However, as per the KVKK, you currently need to submit your written application to the school until the Board specifies the relevant methods. In this context, our school explains the mediums and procedures to be used in written applications, which will be submitted in line with the 11^th article of the KVKK.

You can submit your application by indicating your request and identity information in the form on www.isikkent.k12.tr/KVK_Basvuru_Formu.pdf and delivering a signed copy of the form to Işıkkent School (address: 6240/5 Sokak, No:3, Karacaoğlan Mahallesi 35070 Yeşilova – İZMİR). You can deliver your application by hand, through a notary or via any methods indicated in the KVKK by including the documents of your identification. You can also submit the form to [email protected] by adding a secure electronic signature.

Our school reserves the right make amendments on this document based on the changes in the KVKK and the methods to be specified by the Personal Data Protection Board.

WITHIN THE FRAMEWORK OF THIS INFORMATION NOTE, YOU ARE EXPECTED TO SIGN THE FOLLOWING CONSENT FORM:

As an employee of Işıkkent School, which acts as the Data Controller in accordance with the KVKK numbered 6698 and other relevant provisions, I accept and declare that I read and understood this information note and consent form, copies of which were submitted to me by hand, and learned my rights regarding the processing of my personal data. By signing this form, I also give my consent to processing, collection and protection of my personal data, which are provided by me, acquired by the school or collected via above-mentioned methods, by physical, electronic and other means and in a limited manner as of the beginning of my employment at school until 10 years after the termination of my contract and until there is no reason left for processing my personal data. By signing this form, I also confirm that my personal data can be transferred to local or foreign third parties within our country and abroad based on the restrictions set forth by the relevant legislation and without repeated consent, and that my personal data can be exclusively analysed by automatic systems in accordance with the Law numbered 6698 and the relevant legislation.
